FPL Captain Picker Terms of Use

1. Who we are and how to contact us

FPL Captain Picker is operated by Prem Tipster FPL. In these Terms, “we”, “us” and “our” means Prem Tipster FPL and/or the operator of FPL Captain Picker. “You” means anyone who accesses, browses, registers for or uses the Website or any related service.

2. About the Website

FPL Captain Picker is a Fantasy Premier League-focused tool and content platform. It may include captain-pick rankings, fixture information, projection data, ownership information, probability metrics, saved user picks, premium content, comments, leaderboards, mini-games, competitions, email reminders, newsletters, adverts, sponsorships, affiliate links and related FPL tools.

The Website is provided for information, entertainment and decision-support only. It is not financial, betting, gambling, professional, coaching, statistical or guaranteed outcome advice. Fantasy football decisions remain your responsibility.

We are not affiliated with, endorsed by or officially connected to the Premier League, Fantasy Premier League, the Football Association, individual football clubs or any third-party data provider unless expressly stated.

3. Acceptance of these Terms

By accessing or using the Website, creating an account, logging in, choosing a display name, saving a pick, posting content, joining a leaderboard, buying a paid plan or otherwise interacting with the Website, you agree to these Terms.

When registering, you may be asked to tick a box confirming that you agree to the Terms, Privacy Policy and Naming Rules. That agreement may include your agreement to receive essential account and service emails, including deadline reminders, account notices, security notices, payment notices, feature updates and important service changes.

Marketing and promotional emails are dealt with in the Privacy Policy. Where separate consent is required by law, we will ask for it separately and you can unsubscribe from marketing emails.

If you do not agree to these Terms, you must not use the Website.

4. Changes to these Terms and the Website

• We may update these Terms when features, pricing, legal requirements, data sources, payment arrangements or business plans change.
• We may add, remove, rename, restrict, improve or change features, including free features and premium features.
• If changes materially affect your rights or a paid subscription, we will take reasonable steps to notify you in advance where required or appropriate.
• If you continue to use the Website after updated Terms take effect, you agree to the updated Terms.
• If you do not agree to a material change, you may stop using the Website and, where applicable, cancel any paid subscription.

5. Eligibility

• The Website is not intended for children under 13.
• If you are under 18, you should only use the Website with permission from a parent or guardian, especially if paid features, comments, competitions or prizes are involved.
• You must provide accurate registration information and keep your account details secure.
• We may refuse, suspend or close accounts where we reasonably believe the Website is being misused, accessed unlawfully or used in breach of these Terms.

6. Accounts, login and security

The Website may support email/password login, Google login or other authentication methods. Password handling should be managed through an authentication provider, such as Supabase Auth or another reputable provider. We do not intend to store plain-text passwords.

• You are responsible for keeping your login details secure.
• You must not share your account, sell access or allow others to use your account in a way that breaches these Terms.
• You must tell us promptly if you believe your account has been compromised.
• We may introduce, remove or require email verification, multi-factor authentication or additional security checks, particularly for premium plans, public display names, comments, leaderboards, competitions or admin functions.
• We may log account activity for security, fraud prevention, abuse prevention and service reliability.

7. User roles, free tier and premium tier

The Website may use roles or tiers, including free users, premium users, moderators and super admins. Your access may depend on your role, tier, payment status, account status, location, verification status or compliance with these Terms.

• Free features may be limited, changed, paused or removed.
• Premium features may include advanced statistics, Captain Matrix tools, saved picks, personalised views, early access, leaderboard features, competitions or other benefits.
• Premium feature lists are not permanently fixed. We may add, remove, rename or change features, provided we do not act unfairly or unlawfully.
• We may offer trials, discounts, introductory prices, annual pricing, monthly pricing, promotional plans or lifetime-style promotions, subject to clear terms at the time of purchase.
• We may change prices in the future. Price changes for existing paid users will be handled with notice where required and in a way intended to be fair and transparent.

8. Payments, subscriptions, cancellations and refunds

Paid plans may be introduced in the future. If they are, the price, billing period, renewal terms, taxes, payment method and cancellation options will be shown before purchase.

• Payments may be processed by a third-party payment provider. We do not intend to store full card details ourselves.
• Subscriptions may renew automatically only where this is made clear before purchase and where the law allows.
• You should be able to cancel a renewal through your account or by contacting us, subject to reasonable security checks.
• If the law gives you cancellation rights, we will respect them.
• For digital services or instant access to digital content, you may be asked to confirm that you want immediate access and understand how this affects any cooling-off or cancellation rights where the law allows.
• Refunds may be offered where required by law, where the service has materially failed, or where we choose to offer one at our discretion.
• We may suspend or restrict paid access if payment fails, is reversed, appears fraudulent or breaches these Terms.

9. Data, projections and football information

The Website relies on third-party and internal data sources. Data may include FPL data, fixture data, ownership data, odds, player statistics, projections, injury news, clean sheet probabilities, expected minutes, rest days, defensive contributions, set pieces and other metrics.

• Data can be delayed, incomplete, wrong, stale, unavailable or changed after publication.
• Automated scripts, APIs, mapping tables, aliases and validations may fail or produce unexpected results.
• We may correct, remove, recalculate or republish data at any time.
• We do not guarantee the accuracy, completeness, timeliness or availability of any metric, projection, ranking, model output or recommendation.
• You should not rely on the Website as the only source for FPL decisions, especially close to deadlines.

10. No guarantee of results

The Website may help users compare captain options and FPL decisions, but it cannot guarantee FPL points, rankings, green arrows, prizes, profit, enjoyment, correct decisions or any other outcome. Football is uncertain and data-driven predictions can be wrong.

11. Saved picks, Captain selections and account data

The Website may allow you to save captain picks, vice-captain picks, shortlist choices, column settings, hidden rows, comments, leaderboard entries, predictions, Last Man Standing selections or other account-linked preferences.

• Saved data may be tied to a gameweek, account, browser, device or local storage.
• Some data may be stored locally in your browser and may be lost if you clear browser data.
• We may change how saved data works when accounts, premium tiers or database-backed storage are introduced.
• We are not responsible for losses caused by user error, device issues, browser storage clearing, missed deadlines or unavailable services.

12. Comments, profiles, leaderboards and public features

The Website may allow public or semi-public user features, such as display names, comments, leaderboards, profile pages, share cards, picks, rankings, badges, competitions or community features.

• You are responsible for content you submit.
• We may moderate, hide, edit, reject or remove content that breaches these Terms, the Naming Rules, the law or community standards.
• We may use hidden moderation queues, meaning you might see your own submitted content before it is visible to others.
• Comments may be limited to text only. Links, files, images, spam and promotional content may be blocked.
• We may suspend public features for individual users or for everyone if needed for safety, moderation, technical or legal reasons.

13. Naming Rules

Your display name, profile name, team name, comments and other public identifiers must comply with the Naming Rules. The Naming Rules form part of these Terms. We may update them over time.

14. Competitions, prizes and promotions

The Website may introduce competitions, mini-leagues, prize draws, Last Man Standing games, challenges, badges, rewards, discounts, partner offers or promotional campaigns. These may have additional rules, eligibility requirements, deadlines, geographic limits, prize conditions and verification checks.

• We may require a valid account, verified email, display name compliance and fair use compliance to enter or win.
• We may disqualify entries that are fraudulent, abusive, automated, duplicate, late, incomplete or in breach of the rules.
• Prizes, if any, are subject to availability, eligibility, verification and applicable law.
• We will not run competitions in a way that intentionally requires unlawful gambling, betting or payment for chance-based prizes.

15. Emails, notifications and reminders

By creating an account, you agree that we may send essential account and service communications. These may include password resets, security notices, account notices, deadline reminders, saved-pick reminders, feature updates, payment notices, subscription notices, moderation notices, changes to these Terms and important service messages.

Marketing and promotional emails, such as offers, sponsor messages, paid plan promotions or newsletters, will be sent only where we have a lawful basis to send them. Where consent is required, you will be able to opt in separately and unsubscribe from marketing communications.

16. Advertising, sponsorships and affiliate links

• The Website may include adverts, sponsored content, affiliate links, partner promotions or commercial recommendations.
• Sponsored or affiliate content may earn us a commission or benefit if you click, register or buy.
• We aim to make sponsored or affiliate content clear where required.
• Advertisers, sponsors and affiliate partners do not control your account, ranking data or private information unless we specifically explain otherwise in the Privacy Policy.
• Third-party websites have their own terms and privacy notices.

17. Acceptable use

You must use the Website lawfully, fairly and respectfully. You must not:

• misuse, scrape, overload, attack, reverse-engineer, bypass access controls or interfere with the Website;
• attempt to access accounts, data, admin tools, APIs or systems without permission;
• use bots, automation or bulk activity except where we expressly allow it;
• upload, post or send unlawful, abusive, discriminatory, threatening, sexual, violent, defamatory, misleading, harmful or spam content;
• impersonate another person, club, organisation, brand, admin, moderator or official source;
• sell, resell, share or commercialise premium access without permission;
• use the Website for gambling, betting promotion, unlawful advertising or fraud;
• try to manipulate leaderboards, competitions, comments, polls, votes, metrics or ranking systems.

18. Account suspension, restriction and termination

We may suspend, restrict, remove or terminate your account or access if we reasonably believe you have breached these Terms, broken the Naming Rules, misused the Website, created risk for other users, failed to pay, or caused legal, security, technical or reputational issues.

Where reasonable, we may give you notice or an opportunity to appeal, but urgent or serious cases may be acted on immediately.

19. Intellectual property

The Website, layout, branding, written content, graphics, tables, code, models, rankings, explanations, logos, icons, share-card designs and original materials belong to us or our licensors unless stated otherwise. You may use the Website for personal FPL-related use, but you must not copy, reproduce, redistribute, resell or exploit it commercially without permission.

Fantasy Premier League, Premier League, club names, club badges and other third-party names or marks belong to their respective owners. Any reference to them is for identification, commentary or compatibility purposes only, unless otherwise stated.

20. User content licence

If you submit comments, display names, picks, feedback, suggestions, testimonials, competition entries or other content, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, display, moderate, reproduce and use that content for operating, improving and promoting the Website. You remain responsible for ensuring you have the right to submit it.

21. Third-party services and integrations

The Website may rely on third-party services such as Supabase, payment processors, authentication providers, analytics tools, email providers, hosting providers, API providers, Slack alerts, data sources, social platforms or advertising partners. We are not responsible for third-party outages, changes, errors, pricing, content or terms.

22. Availability, maintenance and beta features

• The Website may be unavailable during maintenance, updates, API failures, hosting issues, data refreshes or unexpected incidents.
• Features may be experimental, unfinished, beta, free-preview or subject to change.
• We may pause features if they produce inaccurate data, legal risk, security risk or poor user experience.
• We do not guarantee uninterrupted access, error-free operation or compatibility with every device or browser.

23. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory rights as a consumer.

Subject to the above, the Website is provided on an “as is” and “as available” basis. We are not liable for losses caused by inaccurate data, missed deadlines, model errors, football events, unavailable services, third-party failures, account misuse, decisions you make using the Website or loss of fantasy football points, ranking, prizes, reputation or enjoyment.

If you are a consumer, you have legal rights that cannot be excluded. These Terms do not take those rights away.

24. Indemnity for misuse

If you misuse the Website, breach these Terms, infringe rights, submit unlawful content or cause claims against us through your actions, you may be responsible for resulting reasonable losses, costs and expenses, subject to applicable law.

25. Privacy

Your personal data is handled according to the Privacy Policy, which forms part of the overall account agreement. The Privacy Policy explains what data is collected, how it is used, why it is used, who it may be shared with, how long it may be kept and what rights you have.

26. Complaints and disputes

If you have a complaint or dispute, please contact us first at premtipsterfpl@gmail.com. We will try to resolve issues fairly and reasonably.

These Terms are governed by the laws of England and Wales, unless mandatory laws in your place of residence require otherwise. If you are a consumer, you may have the right to bring claims in your local courts.

27. Severability

If part of these Terms is found to be invalid or unenforceable, the rest of the Terms will continue to apply as far as legally possible.
